Once a report is complete, by law, consumers are allowed the opportunity to review and dispute any potential inaccuracies before adverse action can be taken against them (for more information, refer to our Background Screening 101 article Pre-Adverse and Adverse Action). While some employers may never encounter a consumer dispute, it is important that they understand the process.
Disputes may occur for a number of reasons, including:
A clerical error was made by a court clerk, such as a misclassification of a charge.
A record for another individual with the same exact name and date of birth was reported.
The subject of the report was a victim of identity theft.
When a consumer files a dispute, it is first reviewed and deemed to be either valid or frivolous. If the dispute is deemed to be valid, the employer is asked to refrain from taking any adverse action against the applicant until a reinvestigation has been conducted (on average, reinvestigations take just a few business days to complete).
To settle a dispute, we contact the original source of the data to clarify and/or obtain additional information to either validate or disprove the applicant's claims. Once the reinvestigation is complete, the report is updated (if necessary) then provided to the consumer and the employer to review the report and make a hiring decision.
