Ban The Box

The state of Georgia issues an Executive Order that declared:

  • Public sector employers cannot ask about arrests of criminal convictions on job applications (except when required for government positions).
  • Having a criminal record is not cause to automatically decline employment to a job seeker.
  • Qualified applicants should be given the opportunity to discuss inaccuracies or contest the content of a criminal record. They should also be allowed to provide evidence of rehabilitation.

Criminal Records From the Georgia Crime Information Center

If an employer takes an adverse action against an applicant based on criminal records obtained from the Georgia Crime Information Center, the employer must inform the applicant about the contents of that record, identify where the record originated and explain how the record led to the employer’s decision.
